Terms of Service.

The agreement governing your use of NeatMail.

1. Acceptance of Terms

By accessing or using NeatMail ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms apply to all users, including free-tier users and paying subscribers. Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference.

We reserve the right to update these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.

2. Service Description

NeatMail is an email management platform that connects to your existing email provider(s) to provide AI-powered email classification, labeling, draft generation, and organizational tools. The Service currently supports Gmail (via the Google Gmail API) and Outlook (via the Microsoft Outlook API).

2.1 Core Features

•Email Classification: AI-powered categorization of incoming emails using OpenAI
•Draft Generation: AI-assisted draft composition based on conversation context
•Email Organization: Labeling, filtering, and bulk management of email threads
•Analytics Dashboard: Insights into email patterns, response times, and productivity metrics

3. Eligibility & Accounts

3.1 Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent.

3.2 Account Registration

Accounts are created and managed through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your login credentials.

3.3 Account Security

NeatMail does not store your email provider passwords. Authentication is handled via OAuth 2.0 directly with Google or Microsoft.

4. Third-Party Services

NeatMail integrates with several trusted third-party service providers. Your use of these services is subject to their respective terms and policies.

4.1 Google Gmail API & Outlook API

Your use of Gmail and Outlook remains subject to their respective terms.

4.2 Clerk (Authentication)

Account creation, login, and identity management are governed by Clerk's Terms.

4.3 Supabase (Database)

Message IDs and operational data are stored in Supabase's managed PostgreSQL.

4.4 OpenAI

AI features are powered by OpenAI. OpenAI does not retain your data beyond the processing request.

4.5 Dodo Payments

Subscription payments are processed by Dodo Payments. We do not store payment credentials.

4.6 Cloudflare

The application is hosted on Cloudflare's platform providing CDN and DDoS protection.

5. Subscriptions & Payments

NeatMail offers a free tier with limited features. Paid plans are billed on a recurring basis (monthly or annually) as selected at checkout. Payment is processed securely by Dodo Payments.

You may cancel your subscription at any time from your account settings. Upon cancellation, paid features remain accessible until the end of the current billing period.

We may change subscription fees with 30 days' notice. Price increases will not apply during your current billing period.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose. Prohibited activities include:

×Violating any applicable law or regulation
×Attempting to circumvent authentication, rate limits, or security controls
×Reverse engineering, decompiling, or disassembling the Service
×Using the Service to send unsolicited bulk email (spam)
×Uploading or transmitting malware, viruses, or malicious code
×Interfering with or disrupting the integrity or performance of the Service
×Scraping, crawling, or harvesting data without written authorization
×Using the Service for any AI model training or data mining

7. Intellectual Property

The Service, including its source code, design, branding, logos, and documentation, is owned by NeatMail and protected by applicable intellectual property laws. You retain all rights to your email data and content.

8. Privacy & Data

Your privacy is important to us. Our data practices are described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

!We disclaim all implied warranties, including merchantability and fitness for a particular purpose.
!We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
!We do not warrant that AI-generated content will be accurate or appropriate.
!We are not responsible for any data loss or email misclassification.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Our total liability for any claims arising under these Terms shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless NeatMail from any claims arising from your use of the Service, your violation of these Terms, or your email content.

12. Termination

You may terminate your account at any time. We may suspend or terminate your account if you materially breach these Terms.

If your account remains inactive for 30 days, we reserve the right to terminate your account and delete all associated data.

13. DMCA & Copyright

If you believe any content on the Service infringes your copyright, please contact us at [email protected] with subject "DMCA Notice".

14. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or posted on the Service.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved by binding arbitration under the Indian Arbitration and Conciliation Act, 1996.
